Terms of service
Last updated: 8 November 2026
These terms are the contract between you and Mundane Bits OÜ, Sepapaja 6, 15551 Tallinn, Estonia (“we”, “us”), for using Pandan. Pandan is a podcast hosting service. When you choose a plan, you agree to these terms.
Questions about anything here go to hello@pandan.fm.
1. What Pandan does
Pandan stores your podcasts and publishes them: an RSS feed for each podcast, its audio files and cover images, and a podcast website. It counts downloads of your audio files. Every plan includes every feature, as many podcasts, episodes, and members as you like, and as much storage as your audio files need.
2. Your account
- You create an account by choosing a plan on the pricing page and starting it at checkout. You need to be at least 18 years old, or act for a business.
- Whoever starts the plan becomes the account’s owner. Owners can add members, who share access to all of the account’s podcasts. You are responsible for what happens in your account, including what your members do, and for keeping your password to yourself.
- Keep your email address current: it is where we send everything about your account and these terms.
- Accounts that we set up by hand, without a plan, follow what we agreed with you, and these terms otherwise.
3. Plans and prices
- Plans differ only in the number of downloads a month. The pricing page shows the plans and their prices. A download is one listener fetching one episode on one day, without bots, as described in How Pandan counts downloads.
- You pay monthly or yearly, in advance. Prices are in euros and include VAT. If you buy for a business in the EU outside Estonia and give your VAT ID at checkout, you pay the same amount without VAT, and the reverse charge applies.
- Payments go through our payment provider Stripe. Stripe sends your receipts and invoices. Owners manage the payment method, invoices, and plan through “Manage billing” in account settings.
- If we change a price, we tell you by email at least 30 days before it applies. The new price applies from your next billing period after that. If you do not want to pay it, you can cancel before then.
4. The trial
Every plan starts with a 14-day trial. Checkout asks for a payment method, but charges nothing. Stripe reminds you by email before the trial ends. When it ends, we charge the first billing period. If you cancel before the trial ends, you pay nothing.
5. Changing and cancelling your plan
- You can move to a larger plan at any time; the difference for the rest of the current period is charged right away. A move to a smaller plan, or from yearly to monthly billing, takes effect at the end of the current period.
- You can cancel at any time through “Manage billing”. Your plan then runs until the end of the period you have paid for, and is not renewed. We do not refund the rest of a period you have paid for, unless the law requires it.
- If a payment fails, Stripe tells you and tries again over the following weeks. If the last attempt fails, your plan ends.
6. Downloads and fair use
- Nobody is cut off for having listeners. If your account has more downloads than its plan allows for two calendar months in a row, we ask you to move to a larger plan. Above the largest plan, we agree on a price with you.
- What delivery costs us is the size of the files, not the number of downloads. The plans assume episodes of about an hour. If your downloads are on average much larger than 100 MB, we talk with you about a plan that fits.
7. When a plan ends
When your plan ends, because you cancelled it, the trial ended after a cancellation, or payments failed, we stop publishing your podcasts: their RSS feeds, podcast websites, audio files, and images go offline. Members can still sign in to the account. We keep everything for 30 days; if you choose a plan again within that time, your podcasts come back at the same addresses. After 30 days, we delete the account and its podcasts. If you want a copy of your files and texts, ask us before then.
If you are moving your podcasts to another host, do it before your plan ends, while your RSS feed and audio files are still online.
8. Your content
- Your podcasts stay yours. You keep all rights to your audio files, texts, and images.
- You allow us to store, copy, and process your content as far as running Pandan needs it: for example to make smaller versions of cover images, and to publish what you publish to anyone, worldwide, in your RSS feed and on your podcast website. This permission ends when your content is deleted from Pandan. Drafts stay private.
- You are responsible for your content. You need the rights to everything you publish, including music, recordings of other people, and images, and to every podcast you import.
- The imprint of a podcast, where the law asks for one, is yours to provide. Pandan never fills it in.
9. Content rules
Pandan is for podcasts. You agree not to:
- publish anything illegal, such as content that infringes someone’s copyright or privacy, defames someone, incites hatred or violence, supports terrorism, or sexually exploits children;
- use Pandan to store or distribute files that are not part of a podcast;
- publish malware, spam, or content meant to deceive listeners or podcast directories;
- attack, overload, or probe Pandan, get around its security, or tamper with how it counts downloads;
- use Pandan for fraud, including registering with someone else’s payment details.
10. Reporting content and what we do about it
Anyone can report content on Pandan they believe is illegal: write to hello@pandan.fm, in English or German. Please name the content and its address, explain why it is illegal, and include your name and email address, unless you report child sexual abuse material. We confirm that we received the report, look at it carefully and without undue delay, and tell you what we decided. We do not use automated tools to moderate content.
If content breaks the law or these terms, we may take it offline, or suspend the account: its podcasts go offline and nothing is deleted. We do the same for fraud and abuse of the service. We tell the account’s owners what we did and why, and how to dispute it, unless the law forbids it or the account was created for fraud or spam. We lift a suspension once its cause is resolved. For serious or repeated violations, we may end the contract without notice.
11. Availability and backups
We work to keep Pandan running at all times, but we cannot promise that it will never be unavailable, for example during maintenance or a problem at our hosting provider. We back up the database every night. Audio files and cover images are stored once, without a separate backup. Keep your own copies of your audio files and images.
12. Ending the contract and deleting your account
- The contract runs as long as you have a plan, and ends with your plan (section 7).
- To delete your account and its podcasts sooner, write to us from the owner’s email address. We delete them within 30 days. Copies in our database backups are deleted within six months, as the backups expire.
- We can end the contract with 30 days’ notice, or without notice under section 10.
13. Liability
- We are liable without limit for damage we cause intentionally or through gross negligence, for injury to life, body, or health, and wherever the law does not allow a limit.
- Otherwise, we are liable only if we breach an obligation that the contract depends on, and only for the damage that is typical and foreseeable for such a breach. Towards businesses, this liability is limited to what the account paid us in the 12 months before the damage.
- We are not liable for lost files that you could have restored from your own copies.
- If someone makes a claim against us because of your content, you support us in defending it and bear its costs, unless you are not responsible for the breach.
14. Data protection
For the personal data in your podcasts, and for your listeners’ data behind your download numbers, you are the controller and we process it on your behalf. Our data processing agreement under Art. 28 GDPR is part of these terms. Counting downloads to bill your plan and to spot abuse, your users’ accounts, billing, and support are our own processing, described in our privacy policy.
15. Right of withdrawal
This section applies if you are a consumer, that is, if you choose a plan for purposes outside your trade, business, or profession.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded, which is the day you start your plan at checkout.
To withdraw, tell us of your decision with a clear statement: write to Mundane Bits OÜ, Sepapaja 6, 15551 Tallinn, Estonia, or to hello@pandan.fm. You can use the model withdrawal form below, but you do not have to. Cancelling your plan through “Manage billing” during the trial has the same effect. To meet the withdrawal deadline, it is enough that you send your withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we reimburse all payments we received from you without undue delay, and at the latest 14 days after the day we receive your withdrawal. We use the same means of payment you used, unless you expressly agree otherwise; you will not pay any fees for the reimbursement. If you asked us to start the service during the withdrawal period, you pay us an amount in proportion to what we provided until you told us of your withdrawal. Because the trial covers the withdrawal period and costs nothing, that amount is zero.
When you start your plan, you ask us to start the service right away, during the withdrawal period.
